Seller Terms
Last updated: October 2026. These apply to every seller, together with the Terms of Service.
1. You are the seller
- Diwali Mela is a marketplace and intermediary. You are the seller of every product you list, and the sale is a contract between you and the customer.
- You are responsible for the product: its quality, safety, authenticity, description, photos, price, GST rate, packing, legality and any warranty. We are not the maker, stockist or seller of your products.
2. Fees
- Registration fee: … including GST, paid once to activate your account. It is not refundable once your account has been verified and activated.
- Commission: we keep a commission on each sale, set by product category and charged on the selling price (which includes GST). A category with no commission set pays none. You see the commission and what you receive on the product form before you list. We may change a rate for future sales.

3. Listing
- List products only in your own category. … products are included in your registration. After that, each extra product costs … to add, paid before it goes for approval. If you have bulk products, please contact our team.
- Show the correct price, GST rate, description and real photos. Do not list counterfeit, unsafe or illegal goods, or goods whose sale is restricted by law.
- Do not take a customer's payment outside the platform.
4. Returns: wrong or defective items are yours
- Customers get open-box delivery and there are no returns for a change of mind. A return or replacement is accepted only for a wrong product, or a defective or damaged product, reported within 48 hours with proof.
- If your product is defective, damaged or wrong, you must replace it or refund the customer, and you pay all the charges (the item, return pickup and replacement delivery). We may set this off against your payouts and recover any balance from you.
- Send exactly what was ordered, in good condition, well packed.
5. Cancellations
If a customer cancels a paid order before it is packed and handed to the delivery partner (the shipping manifest; after that it cannot be cancelled), they are refunded the total less a 2% cancellation charge (payment charges).
- If the customer cancels, the customer bears the 2% charge and you are charged nothing.
- If you cancel an order (you can, until you press Mark Packed), the customer is refunded in full and a 2% cancellation charge on the value you cancelled is taken from your wallet, which means it comes off your earnings in your next payout. If you have no earnings yet, it waits and is taken from the next ones. Cancel only if you really cannot supply the order. Repeated cancellations may lead to action on your account.
5A. Takeaway orders
- Customers may choose to collect an order from your shop on a date they pick. You can switch this off in Settings.
- They pay a 20% advance online and pay you the balance at the shop. You see the pickup date and the balance to collect under Orders.
- When the customer has collected and paid you, press Takeaway completed. The platform commission (on the whole order, by category) comes out of the advance and what is left is added to your payout. If the commission is more than the advance, nothing more is charged to you.
- If the customer does not come, press Not collected: the order is cancelled, the stock returns and the admin decides the refund of the advance.
- Do not collect the balance before the customer has the goods, and give the customer exactly what was ordered. Wrong or defective items are your responsibility, as in section 4.
6. Payouts
- Your earnings (after commission) from delivered and paid orders are paid by bank transfer to your verified bank account.
- Payouts are made by us manually and are not instant. Add your bank details under Payouts & Earnings: we cannot pay without them.
- Every payout is paid after TDS. TDS is deducted at 0.1% on the gross sales paid out, once your payouts in a financial year pass …. It is deposited with the government in your name. A payout invoice showing it is emailed to you each time.
6A. Packing and handing over
- Pack each order well and hand it to the delivery partner on time. Once you mark an order packed it goes into the delivery manifest and the customer can no longer cancel it. Until then a customer may cancel at any moment; the stock returns to you and you are not paid for that order.
- Delivery is open-box. Include the invoice, and write the correct MRP, date of making and expiry on food and perishable items.
- You must not ship an order that was cancelled, and you must not ask a customer for extra money for delivery or packing.
6B. Licences, tax and the law
- You confirm that you hold every licence and registration your goods and business need (for example FSSAI for food and sweets, GST where required, a trade licence, and a licence for any regulated goods), and that you will keep them valid and show them when asked.
- You are responsible for your own GST, income tax and other taxes. Show the correct GST on each product. Fireworks, explosives and other goods that the law restricts or bans may not be listed. Counterfeit, stolen, unsafe or misdescribed goods are banned, and so is any product we ask you to remove.
- You will follow the Consumer Protection (E-Commerce) Rules, 2020, the Legal Metrology (Packaged Commodities) Rules and every other law that applies to what you sell, including showing the country of origin and the seller details where required.
6C. Customer data
You get a customer's name, phone number and address only to complete that order. Use it for nothing else, do not keep it longer than you need, do not share or sell it, and do not contact the customer for marketing. You must follow the Digital Personal Data Protection Act, 2023. Misuse is a ground for removing you at once.
7. Our rights
We may hold payouts, suspend your account or remove a listing for a breach of these terms, a fraud concern, repeated complaints or a legal requirement. We may set off against your payouts any refund, charge or amount you owe us, and recover the rest from you. We may change commission, fees and these terms for the future, with notice on the seller portal; if you carry on selling after that, you accept the change.
8. Your responsibility to us and to customers
- You will compensate the Company, its directors and employees for any claim, penalty, refund, loss or cost (including reasonable legal fees) that arises from your products, your listings, your breach of these terms or of any law, an infringement of anyone's rights, or your handling of customer data.
- The Company is a marketplace and is not liable for the quality, safety or legality of your products, for loss caused by a customer, a courier, a bank or a payment provider, or for an event beyond its control. Where the Company is held liable to you, it is limited to the payouts due to you and unpaid. The Company does not promise any amount of sales.
- Nothing here excludes a liability that the law does not allow to be excluded.
9. Ending
You may close your account by writing to us once your open orders and any dues are settled. We may suspend or end your account for a breach, fraud, repeated complaints or a legal requirement. Dues and payouts that are owed are settled, after TDS and set-off. Sections on liability, compensation, data and disputes continue after you leave.
10. Acceptance, law and disputes
You accept these Seller Terms, with the Terms of Service and the Privacy Policy, by ticking the box when you start your KYC. The date and version are recorded. You confirm that you are 18 or over and have the right to sell what you list. These terms are governed by the laws of India. The parties will first try to settle a dispute by talking; the courts at Gautam Buddha Nagar, Uttar Pradesh have exclusive jurisdiction.
